TRANSPARENCY

The G.B. Bietti IRCCS Foundation is a non-profit organization that maintains economic relations with public administrations. As such, it has an obligation (based on the Law 124/2017, “Annual Law for the market and competition”) to publish each year, on its website, information relating to grants, contributions, paid assignments and any kind of economic advantages, received by the same public administrations in the previous year (see Article 1, paragraphs 125-129).

Financial Statements

The right of civic access allows citizens to access data, documents, and information held by public administrations or by public service concessionaires.

This right applies both to data subject to mandatory publication (where such data have not been made publicly available) and to any other data — in the latter case, within the limits established by law to protect other public and/or private interests (Article 5-bis of Legislative Decree No. 33/2013).

Accredited private healthcare facilities are subject to the right of civic access only with regard to data, documents, and information related to the provision of healthcare services.

Requests must allow the facility to identify the specific data, document, or information being sought; therefore, generic requests are not admissible.

If a request concerns a manifestly unreasonable number of documents, such as to impose a workload that could compromise the proper functioning of the healthcare facility, the facility may reject it in order to safeguard the efficiency of administrative operations.
The release of data or documents in electronic or paper format is free of charge, except for the reimbursement of actual costs incurred and documented by Fondazione Bietti for reproduction on physical media.

Requests for simple or generalized civic access, pursuant to Article 5, paragraphs 1 and 2, of Legislative Decree No. 33/2013, must clearly identify the requested data, information, or documents and may be submitted to the following address:

Once the request is received, the Administrative Directorate will designate a staff member responsible for handling the request, appointing them as the Responsible Officer for the Procedure (“Responsabile del Procedimento”).

Substitute Authority

In cases of delay or failure to respond, the applicant may appeal to the Substitute Authority, pursuant to Article 2, paragraph 9-bis, of Law No. 241/1990 and subsequent amendments.
This role is assigned to the Administrative Director of the IRCCS Fondazione Bietti, who, upon verifying the obligation of publication, shall ensure publication within 15 days and simultaneously inform the applicant.
